APPLICATION U/S 497 Cr:P.C FOR RELEEASE OF THE ACCUSED/ PETITIONERS ON BAIL TILL THE FINAL DECISION OF THE CASE.

FACTS:

 

1.     That the accused/ petitioner have falsely been implicated in the above noted case by the local police station of Kalkot District Dir Upper on the report of Respondent No. 2 Bacah and since he is in judicial lockup. (Copy of the FIR is enclosed herewith and marked as Annexure (A).

 

2.     That the accused/ petitioner submitted application for his release on bail to the learned Additional Sessions Judge II/ Izafi Zilla Qazi Dir Upper.

3.     That the learned Additional Sessions Judge II/ Izafi Zilla Qazi Dir Upper rejected the bail application of the petitioner vide order dated 15/01/2015. (Copies of bail application and order dated 15/01/2015 are enclosed herewith and marked as “B” annexure “B&C”).

 

4.     That the accused/ petitioner being aggrieved from the above said order of the Court below approach this Hon’able Court for his release on bail, inter alia on the following grounds.

 

GROUNDS:

 

A.               That the impugned order passed by the learned Court below is contrary to law, facts and material available on record of the case.

 

B.               That the accused/ petitioner is innocent and he is falsely been implicated with malafide intention by the complainant in the above noted case.

 

C.               That the occurrence took place the midnight at 21:00 O’clock.

 

D.               That the complainant in his first information report, had never directly nominated the accused/ petitioner but the prosecution witnesses charged the accused/ petitioner in their statements under section 164 Cr.P.C on 08/08/2000.

 

E.                That except the bare allegations in the FIR, there is no eye witness and no independent iota of evidence/ material on record with could connect the accused/ petitioner with the commission of alleged offence.

 

F.                That FIR is tainted with malafide and the allegations are furtherance from truth to the extent of the petitioner. Hence the allegations need further inquiry.

 

G.               That the prosecution case against the accused/ petitioner is doubtful, requiring collection of further evidence with the meaning of section 497(2) Cr:P.C.

 

H.               That the FIR has been lodged after due deliberation and consultation all most after huge unexplained delay, which has made case of the prosecution highly doubtful.

 

I.                   That no recovery what so ever has been affected from the accused/ petitioner and no confessional statement have been recorded by the accused/ petitioner.

 

J.                  That the accused/ petitioner is no more required for further investigation.

 

K.               That the accused/ Petitioner belong to a respectable family of the settled area, ready to submit reliable sureties to the satisfaction of this Hon’able Court, which could make it sureties attendance of the accused/ the petitioner before the competent Court of law, when and where they are required.

 

L.                That if any ground which has not been taken in this petition may kindly be allowed to argue the same during the course of arguments, in the aforesaid circumstances, it is, therefore, respectfully prayed that on acceptance of the application accused/ petitioner may kindly be allowed bail till the final decision of the case.
